| 1 Application of terms and conditions
1.1 The attendance of each visitor (“Visitor”) at the Ambulex 2014 Ambulance, Accessible and Community Vehicle Exhibition (“Event”), run by Rescroft Limited, trading as Ambulex (“Ambulex”) at the Ricoh Arena, Coventry (“Premises”), is subject to the following terms and conditions. Any refusal to act in accordance with these terms and conditions may lead to your removal from the Event.
1.2 In consideration of Ambulex permitting you to attend the Event, you agree to comply with these terms and conditions and all terms and conditions contained in the Ricoh Arena’s visitor terms and conditions applicable to the Event (“Ricoh Arena Terms”).
1.3 Notwithstanding any other provision of these terms and conditions, entry to and attendance at the Event by any Visitor is entirely at Ambulex’s discretion and Ambulex reserves the right to remove any Visitor from the Event and the Premises as it sees fit.
2 Conduct at the Event
2.1 Each Visitor shall not:
2.1.1 cause a nuisance to exhibitors of the Event (“Exhibitors”), the Ricoh Arena (or its employees or representatives) or to occupants of any premises adjoining the Premises;
2.1.2 engage in any form of disruptive or anti social behaviour whilst on or around the Premises;
2.1.3 sell, provide or offer in any manner, any food, drinks (both alcoholic and non alcoholic drinks), cigarettes, any other tobacco or any other consumable of any nature whatsoever, unless the same has been permitted by Ambulex;
2.1.4 sell, provide, offer or promote any goods or services of whatever nature, including, but not limited to, brochures, books and magazines, unless the same has been permitted by Ambulex;
2.1.5 promote any product or service, other than the products and/or services of the exhibitors (and then only in accordance with the terms applicable to exhibitors);
2.1.6 do, or cause to be done, anything on the Premises which is illegal or immoral;
2.1.7 use the Premises for, or engage in, betting or gaming or the holding of a lottery on the Premises;
2.1.8 bring, or permit any animals to be brought, onto the Premises unless such animals are guide dogs or animals providing equivalent assistance; or
2.1.9 not take films, video tapes or photographs of the Premises.
2.2 Each Visitor must, at all times, remain within the Visitor permitted areas of the Event.
2.3 All Visitors must keep all their personal belongings with them. Ambulex accepts no responsibility for the loss, theft of or damage to the personal belongings of any Visitor which are brought to the Event.
2.4 Ambulex reserves the right to search any Visitor whilst at the Event and each Visitor must submit to such searches.
3 No guarantee and liability
3.1 Each Visitor’s attendance at the Event is at all times subject to the agreement of the Ricoh Arena and Ambulex provides no guarantee that such agreement will be given.
3.2 Ambulex does not guarantee the availability or the occurrence of any facilities or activities at the Event (including accommodation and parking). In the event of the cancellation of the Event or in the event that any facilities or activities are not available to any Visitor, Ambulex shall not be liable in any way whatsoever for any costs or expenses (including but not limited to travelling costs) incurred by any Visitor in relation to the Event or such facilities or activities.
3.3 Each Visitor acknowledges and agrees that products and services offered at the Event may not be products or services of Ambulex and the provision, sale or promotion of any product or service at the Event should not be treated as an endorsement by Ambulex of any such product or service.
3.4 Ambulex accepts no liability whatsoever in relation to any product or service offered, sold or promoted at the Event. For the avoidance of doubt, this clause does not apply to products and/or services sold by Ambulex, for which the extent of Ambulex’s liability can be found in the relevant terms and conditions of sale.
3.5 Ambulex accepts no liability whatsoever for damage to or theft of or from vehicles parked at the Premises, save where such damage or theft is cause by Ambulex’s wilful act. Each Visitor acknowledges that the use of any car parking facilities is at their own risk.
3.6 Nothing in this clause 3 shall limit or exclude Ambulex’s liability for death or personal injury caused by its negligence or fraud or fraudulent misrepresentation.
4 Indemnity
Each Visitor shall indemnify Ambulex against all liabilities, costs, expenses, damages and losses (including any direct, indirect and consequential losses, loss of profit and loss of reputation) suffered or incurred by Ambulex arising out of or in connection with any act or omission of such Visitor which causes Ambulex to breach, or which results in a breach by Ambulex of, any of the Ricoh Arena Terms.
5 Severance
If a provision of these terms and conditions (or part of any provision) is found illegal, invalid or unenforceable, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
6 Entire agreement
6.1 These terms and conditions (and the clauses of the Ricoh Arena Terms) constitute the whole agreement between the parties and supersedes all previous agreements between the parties relating to its subject matter.
6.2 Each Visitor acknowledges, on registering to attend the Event, that they have not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) (other than for breach of contract), as expressly provided in these terms and conditions
6.3 Nothing in this clause shall limit or exclude any liability for fraud.
7 Governing law and jurisdiction
7.1 These terms and conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, the law of England and Wales.
7.2 Each Visitor and Ambulex irrevocably agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim that arises out of, or in connection with, these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).
